YOGA RETREATS
Refund Cancellation Policy
All yoga retreats are none refundable unless we can resell your place.
If you have entered into a payment plan you will be held accountable for completing the agreed payments at the agreed times.
Unless exceptional circumstances and upon proof of a doctors note we may be able to make allowances.
1.1. By using the Kirsty Brown Cookery School and booking a course, yoga supper club or purchasing a gift voucher for the Kirsty Brown Cookery School or yoga supper club you agree to accept these terms and conditions.
1.2. These terms and conditions are governed by the law of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.
COOKING CLASS BOOKINGS
2.1Bookings may be transferred with our consent. (does not apply for supper club/yoga retreats) We will make every effort to accommodate your request to transfer the booking to another date. Please contact the school directly should you wish to transfer the booking.
2.2. Courses run in groups. The numbers will vary without notice. We do offer private lessons and private group classes if this is a problem.
2.3. You must notify us if you have any specific dietary requirements or allergies by whatsapp or email before we send your ingredients list out. It is your responsibility to check all labels for ingredients on products etc for yourself or your children.
2.4 By submitting payment you are providing a guarantee that the person booking the class will be 18 years old or over at the time of the class. Minors wishing to participate in courses at The Kirsty Brown Cookery School may do so subject to complying with the following requirements:
16 -17 year olds – may attend a class alone provided a Parental Consent Form has been signed by the minor’s parent or guardian and returned to the Kirsty Brown Cookery School. Please ask in advance for this.
Under 16s must have an adult present in the kitchen/place where cooking is taking place. Children must be supervised using any knives, electrical or cooking equipment or handling raw meat etc.
Health & Safety

3.1. We are not liable for any damage which occurs to clothing or belongings.
3.2. Long hair should be tied back when students are in the kitchen. Sleeves rolled back. Appropriate clothing and flat shoes with covered toes must be worn by students attending a cookery class.
3.3. Every child or adult attending a course will be given safety advice around, knives, heat and hygiene. By attending the class you agree to: adhere to the advice; ensure that your child complies with all instructions given regarding safety; uphold reasonable standards of cleanliness and behavior.
3.4 It is your responsibility to ensure that all your equipment is in good working order and do your own fire risk assessment re deep fat frying etc. It is your own responsibility to be up to date with the latest advice on fire prevention regarding these. You must be up to date with knowledge of first aid treatment of burns etc. We will not be held responsible for any kitchen accidents or injuries.
Liability
4.1. The Kirsty Brown Cookery School is not liable to you for, and does not have responsibility for: accidental damage or injury resulting from the actions or omissions of, you or anyone attending the course; or any loss of income or revenue, loss of profits or contracts; or any indirect or consequential loss or damage that you may suffer as a result of our breach of contract or negligence.
4.2 Occasionally there may be internet problems beyond our control, we will endeavor to resolve these as quickly as possible. If these can not be resolved we can book you onto another class for free. If you, yourself have one off internet problems then the same applies.
4.3. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence in person classes, for fraud or fraudulent misrepresentation, or for any matter which it would be illegal for us to exclude our liability.
4.4 All customers attending our courses are responsible for their own belongings and we accept no liability for any loss to damage to these.
5.Full payment must be made at the time of booking. Your place on any selected course shall only be reserved after full payment has been received.
Cancellations and Refunds Cancellations by us
6.1. We reserve the right to cancel or reschedule any course dates and if we do, we will do our best to notify you as soon as possible.
6.2. If, for any reason, we cancel the course we will endeavor to rearrange the class on an alternative date within a reasonable period of time. If this is not possible, or you are unable to attend the course on a revised date, the full purchase price of the course will be refunded to you.
6.3. Unfortunately in these circumstances, we are not liable for and are unable to reimburse any additional expenses you may have incurred in relation to the cancelled course.
6.4 If you cancel the course/supper club giving prior notice of 30 days or less from the course date, you will still be charged the full fee for the course. No refunds given if cancelled within 30 days. See first paragraph for the yoga retreats these are none refundable unless resold.
Nothing in these terms and conditions affects or limits your statutory rights.
Data
7.1. Any personal data you provide, through the booking system or any other details will be processed in strict accordance with our Privacy Policy, which can be accessed on our website.
USE OF WEBSITE AND BOOKING SYSTEM
Kirsty Brown Cookery School uses woocommerce, the online booking platform https://woocommerce.com and Stripe https://stripe.com for taking payments. Please refer to the websites of these two platforms should you wish to view their terms and conditions and privacy policy.
“You” or “you” or “Parent” is an individual who visits the website and/or registers on the website. “Organiser” is the person who works for Kirsty Brown Cookery School for the purposes of running the administrative aspects of the school and classes.
We ask that you read through these terms of use which apply whether you have created an account with us or are just visiting the website and govern:

- The relationship between Adults/Parents and Organisers
These terms apply to the use of the website and by accessing and using the website you agree to be bound by the terms set out below. If you do not agree to be bound by these terms, you may not use or access the website.
- Who are we?
We are Kirsty Brown Cookery School, Small Independent Business, Sole Trader.
- Our Services
We use this website to bring you information and listings for events, classes and groups for children and adults.
We aim to provide constant and uninterrupted access to the Services, but we do not take responsibility for issues outside our control, such as internet or connection issues. Specifically we do not guarantee that:

- the availability of the website on each and every device or platform all of the time;
- any technical issues that arise can be resolved quickly; and
- the website is error, virus or bug free.
- Accessing the Services
If you would like to use the Services, you will have to provide us with your personal details and contact information in order to create a booking on the woo commerce platform.
You warrant that the personal information which you are required to provide when you create your Account is true, accurate, current and complete in all respects.
If you create an account you’ll be able to

- review your information
- make any necessary changes or amendments to keep your personal information up to date and accurate
- remove any details that are no longer relevant
From time to time, in order for us to deliver the Services effectively it will be necessary for us to send you information and updates about our Services by email and/or text e.g. invoices, invitations to book or pay, booking confirmations, etc.
From time to time, in order for Organisers to deliver the Classes it will be necessary for them to send you information and updates about the Classes by email and/text e.g. cancellations, rescheduling, equipment requests, and other specific reminders.
- Booking a class
Selecting the book a class section to book the time/date that suits you. Once you have made a booking, the Organiser will be allowed access to your booking on woo commerce. Making the booking connects your booking details to the Organiser. Organisers will not be able to see your personal information before you complete a booking with them.
In order to deliver certain Classes some users may need to give additional information re: levels of ability, any specific access requirements/allergies etc. Whilst the Additional Information will be stored on the email it will be regarded as being shared personal information that is controlled by the Organiser. The organiser will be required to comply with all of the obligations imposed on a controller under the Data Protection Legislation (as defined below).
Organisers will have the ability to download or export personal information held within the Parent Account for their own legitimate business purposes, i.e. names of people booked on for class registers.
- Payment
The Platform enables you to pay fees for Classes direct to the Organiser via our online payment partner, Stripe. The information which you provide during the payment process will be governed in accordance with Stripe’s Terms and Conditions https://stripe.com/gb/legal.
Alternatively, other methods of payment can be arranged with the Organiser direct.
- Your privacy
Data Protection Legislation means (i) the Data Protection Act 1998, until the effective date of its repeal (ii) the General Data Protection Regulation ((EU) 2016/679) (GDPR) and any national implementing laws, regulations and secondary legislation, for so long as the GDPR is effective in the UK, and (iii) any successor legislation to the Data Protection Act 1998 and the GDPR, in particular the Data Protection Bill 2017-2019, once it becomes law.
Any personal information provided by you to us will be held and processed in accordance with the data protection principles set out in the Data Protection Legislation for the purposes of meeting the legitimate business interests of ClassForKids and adhering to the rights of the individual.

We will treat all your personal information as confidential. We will keep it on a secure server will fully comply with all applicable Data Protection Legislation.

- Your child’s name
- Other special information re: you or your child including any relevant health or medical information*
- Emergency contacts – name and phone number
*Personal data concerning health is a special category of personal data under GDPR. By accepting these Terms of Use you are providing Kirsty Brown Cookery School with explicit consent to processing any special category personal data provided by you to enable the Organisers to deliver the Classes.
We will use your personal information only for the following purposes:

- To fulfil delivery of the Services
- To communicate with you about Kirsty Brown Cookery School and the Classes
- To provide you with Kirsty Brown Cookery School news and product changes
- Send timely and relevant reminders
- If you consent, to send you Marketing Messages
You agree that you do not object to us contacting you for any of the above purposes whether by phone, e-mail or post and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Data Protection Legislation.
You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal information, we are entitled do so.
Collecting, holding and processing your personal information is necessary for the performance of these Terms of Use to which you, as a data subject, are party. We also collect, hold and process your personal information under the lawful basis for processing of legitimate interests i.e. the processing is necessary for our legitimate interests and running the Kirsty Brown Cookery School business or the legitimate interests of a third party unless there is a good reason to protect the your personal information which overrides those legitimate interests.
As required by law, we shall not retain any personal data for any longer than is necessary in light of the above purpose(s) for which that data is collected, held, and processed. We retain personal data on the booking platform for a period of six years.

We would like to keep you up to date with new Classes and Organisers; relevant offers for products and services from selected third parties related to the Classes which you have registered for to date and suggestions of Classes and relevant products and services from selected third parties which we think might be of interest to you but which are not necessarily linked to Classes which you have registered for previously.
If you choose to opt-in below, whilst Kirsty Brown Cookery School will send you Marketing Messages we will not share your personal information with any Organisers with whom you have not booked, or with any other external third party. Your personal information will remain on the Platform under our control.
If you choose not to receive Marketing Messages, Kirsty Brown Cookery School will be restricted from using your personal information to make personalised recommendations.
For the avoidance of doubt, your acceptance of these Terms of Use will not mean that you have agreed to receive Marketing Messages.
- Our rights
We reserve the right to:

- modify or withdraw, temporarily or permanently, the website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; and/or
- change these terms of use from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the terms of use have been changed. If you do not agree to any change to the terms of use then you must immediately stop using the website.
- Your use of the Platform
You agree to use the website only for non-commercial, lawful purposes, and in a manner that does not infringe the rights of third parties, or restrict or inhibit the use and enjoyment of the website by any other user.
Specifically, you agree you shall not:

- do anything that brings (or in our opinion is likely to bring) Kirsty Brown Cookery School into disrepute.
- embed, upload, or make any of the website available via any third party platform, website or service without our prior consent
- copy, reproduce or otherwise publish any of our trademarks or logos
- frame the website on other websites without our express permission
You agree fully to indemnify, defend and hold us, and our officers, employees, suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms of use by you or any other liabilities arising out of your use of the website, or the use by any other person accessing the website using your Account and/or your personal information.
- Breach of these terms of use
We will determine, at our sole discretion, where there has been a breach of these terms of use. Where we suspects that a breach has occurred, we may take such action as we deem appropriate which may include all, or any, of the following:

- Immediate, temporary or permanent withdrawal of your right to use the website/cookery school.
- Issue of a warning to you
- Commencement of legal proceedings against you
- Disclosure of information to law enforcement authorities
We exclude any liability for lawful actions taken by us in response to breaches of these terms of use and we reserve the right to seek compensation from you for any loss or damage we may suffer as a direct consequence of any breach by you of these terms of use.
If you breach any of these terms of use, and we choose not to take action against you, that does not necessarily mean that we will waive any subsequent breaches by you. In addition, if we do not exercise the entire remedy available to us, we may still do so at a later date.
- Our Liability
In no event shall we be liable for any claims, loss or damage, arising out of or in connection with your use of, or inability to use, the website, including, without limitation, direct or indirect loss, consequential loss or damage, loss of profit or goodwill, or for loss arising from any errors or omissions in the website.
- Severance
If any part of these terms of use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms of use and shall not affect the validity and enforceability of any of the remaining provisions of these terms of use.
- Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with UK law. All disputes arising from them shall be submitted to the non-exclusive jurisdiction of the UK courts
